    Changes to Spanish Insolvency Act to cater for the COVID-19 outbreak

    The Spanish Government has just approved relevant changes to the Spanish Insolvency Act in view of the current situation in Spain pursuant to the COVID-19 outbreak.

    The new Royal Decree 16/2020, of 28 April

    Before Royal Decree 16/2020, of 28 April ("RD 16/2020"), was approved, certain temporary changes had already been introduced as a matter of urgency to Spanish Act 22/2003, of 9 July (the "Spanish Insolvency Act"), by Royal Decree 8/2020, of 17 March ("RD 8/2020").

    • The Law for the amendment of the Spanish Insolvency Law that transposes Directive 2019/1023 (Directive on restructuring and insolvency) (the Law) has been sent to the Spanish Congress for its final approval after which it will be published in the Spanish Official Gazette, and twenty days thereafter the Law will enter into force, excluding some articles.

    The Law sets out structural reforms in pre-insolvency and insolvency regulations to achieve the following goals:

    New financial support measures approved by the Spanish Government

    Spain’s COVID-19 support measures extended: what it means for insolvencies

    The Spanish Government has extended the various support measures aimed at helping Spain deal with the economic impact of COVID-19.

    This blog post summarises the most relevant new insolvency measures of Royal Decree-Law 5/2021 (‘the RDL’), which was approved on 12 March 2021 and entered into force on 13 March 2021.

    Debtor's duty to file for insolvency

    The deadline to file for voluntary insolvency has been extended until 31 December 2021 (the previous deadline was 14 March 2021).
