Restructuring in Turkey: A new paradigm?

As more Turkish companies begin to report liquidity issues and economic pressures begin to bite, successful financial restructurings are likely to become increasingly critical to the prosperity of the Turkish economy

Only time will tell whether local processes will provide a suitable toolkit for large-scale corporate restructurings, or whether other international restructurings processes may also have a role to play.

New Measures to Be Taken By Turkish Companies in Technical Bankruptcy & Financial Distress

The Ministry of Trade introduced the Communiquéon the Implementation of Article 376 of the Turkish Commercial Code Numbered 6102 ("Communiqué") detailing the measures to be implemented in companies subject to technical bankruptcy.

What's New?

The Communique provides helpful guidance about how companies and their shareholders and management must address a company's financial distress.

Debt enforcement tips in Turkey

Relief from forfeiture not limited to rights over real property
2013-04-03

In Cukurova Finance International Ltd v Alfa Telecom Turkey Ltd [2013] UKPC 2, the Privy Council held that a borrower may claim relief from forfeiture notwithstanding that the forfeited security has been appropriated by the lender in satisfaction of a debt.
