    As empresas portuguesas que registem paragens na produção, por motivos de reestruturação da organização produtiva, podem candidatar-se a um apoio financeiro aos custos suportados com formação e encargos salariais.

    A Portaria n.º 367/2024 de 29 de fevereiro criou o programa “Qualifica On” que permite aos empregadores portugueses obter um incentivo financeiro pelos custos suportados com formação dos seus trabalhadores e com encargos salariais (remuneração, contribuições sociais e subsídio de alimentação).

    Portugal's restructuring and insolvency paradox

    In a report which was made public in May 2023, the IMF reviewed its 2023 GDP growth predictions for Portugal at 2.6%. This is just after it had predicted a growth rate of 1% in April (in itself, a leap from the projections made in October 2022 which set growth at 0.7%). According to public sources, these predictions are based on an analysis of the country's economic performance in 2022 and the first quarter of 2023.

    STJ decide que créditos do proprietário fiduciário não se submetem à recuperação

    A Terceira Turma do Superior Tribunal de Justiça (STJ) deu, por unanimidade, parcial provimento ao Recurso Especial n°. 1.933.995 – SP (REsp), interposto em face da decisão proferida pelo Tribunal de Justiça de São Paulo (TJSP), reafirmando o entendimento de julgados anteriores no sentido de que os créditos do proprietário fiduciário não estão sujeitos aos efeitos da recuperação judicial, independentemente da relação do fiduciante ou do fiduciário com o bem imóvel dado em garantia ou com a própria empresa em recuperação.

    The no creditor worse off principle in the resolution of insurers

    The proposal for a directive on the recovery and resolution of insurance and reinsurance companies enshrines the no creditor worse off principle as provided for in the Bank Recovery and Resolution Directive (“BRRD”). This opens the door for the Portuguese legislature to repeat the mistakes it made when incorporating the BRRD into Portuguese law

    No creditor should incur greater losses in the resolution than if the firm undergoing resolution had been wound up in normal insolvency proceedings
