    Aussonderung kryptobasierter Vermögenswerte und Zugang zu Daten im Konkurs

    Ob verwahrte kryptobasierte Vermögenswerte bereits mit Hilfe von Art. 242 SchKG ausgesondert werden konnten, war in der Lehre bisher umstritten. Am 1. August 2021 ist nun Art. 242a SchKG in Kraft getreten, der Klarheit bei der Aussonderung kryptobasierter Vermögenswerte schafft.

    Neu wird zudem mit Art. 242b SchKG ein gesetzlicher Anspruch für den Zugang zu Daten geschaffen, die sich in Gewahrsam der Konkursmasse befinden. Damit wurde ein weitgehend unbestrittenes Anliegen ins SchKG aufgenommen.

    Ninth Circuit Affirms Summary Judgment for CRA in FCRA Litigations, Reiterating Requirement of Actual Harm for Negligent Violations of the Statute

    Changes to the UK Insolvency Regime - Ipso Facto and Termination of Supply Contracts

    Last year the Corporate Insolvency and Governance Act (the Act) made both temporary and permanent changes to the UK insolvency laws.

    As part of these measures, a provision was inserted into existing legislation which curtails the ability of suppliers to terminate supply contracts when a customer becomes insolvent (the so called `ipso facto regime').

    Scheme of Arrangement to Restructure Foreign Debt

    In Re Freeman FinTech Corporation Ltd [2021] HKCFI 310, the Hong Kong court sanctioned a scheme of arrangement in respect of a debt restructuring in which the governing law of part of the debt was not Hong Kong law and the creditor to whom this debt was owed did not submit to the jurisdiction of the Hong Kong court. In this article, we discuss the background and rationale for the decision and provide some observations on what the decision may mean for future debt restructurings.
