Gable Insurance, whose insurances were mediated in Denmark by Husejernes Forsikring, went into bankruptcy proceedings in November 2016. In light of the bankruptcy and its effects of rendering Danish insureds without cover, the Danish Parliament passed new regulation regarding guarantee funds for insurance companies on 11 May 2017.

Amendment to the Stock Corporation Act: The Amendment to the Stock Corporation Act 2016 (Aktien-rechtsnovelle 2016) introduced, among other things, the option to issue preference shares without subsequent payment, an extended conversion right for convertible bonds, a limitation of the issue of bearer shares for non-listed companies and new provisions on the due dates of dividend payments.
Die aus Sicht der deutschen Volks- wirtschaft erhebliche Kapitalanlage- tätigkeit von Versicherungsunterneh- men (VU) unterliegt den aufsichts- rechtlichen Vorgaben des Versiche- rungsaufsichtsgesetzes (VAG). Im Hinblick auf die Vorgaben der euro- päischen Solvency II-Richtlinie haben sich mit Inkrafttreten des neuen VAG zum 1. Januar 2016 (VAG n.F.) Ände- rungen der Anforderungen an die Kapitalanlage von VU ergeben. Dies gibt Anlass, einen Blick auf die wichtigsten Neuerungen zu werfen.
A. Bisherige Rechtslage
The economically significant investment activity by insurance companies is subject to the regulatory requirements of the German Insurance Supervision Act (Versiche rungsaufsichtsgesetz – VAG). With regard to the provisions of the European Solvency II Directive, changes to the requirements for capital investments of insurance companies have resulted from the new VAG which came into effect as of 01 January 2016 (VAG new). This gives us cause to take a look at the most important changes.
A. Former legal situation
In view of the impending Solvency II Directive (Directive 2009/138/EC), which will be fully applied as of 1 January 2016, and the considerable changes associated with the directive, the (German) insurance landscape will not remain in its current state.

The Federal Labour Court has ruled on the fundamental issue of who will be entitled to the rights under a life insurance policy concluded by the employer in the employee’s favour in the event that an employment relationship comes to an end in the course of the employer’s insolvency proceeding.
Generally, financial services firms in Germany (Finanzdienstleistungsinstitute) are mandatory members of a protection scheme (Entschädigungseinrichtung der Wertpapierhandelsunternehmen - EdW). Members of this protection scheme are obliged to make regular financial contributions.
In 2005 Phoenix Kapitaldienst GmbH became insolvent and the EdW is due to pay out to Phoenix investors compensation which totals more than 100 million Euros. However, the EdW has insufficient funds to cover the entire amount due.
