    Restructuring plan and rescue aid for TAROM: European Commission opens in-depth investigation

    The European Commission decided on 5 July 2021 to open an in-depth investigation into the restructuring plan of the airline TAROM notified by Romania in May 2021, as well as into the EUR 190 million aid to support it under the Guidelines on State aid for rescuing and restructuring undertakings in difficulty.

    The Romanian airline TAROM has been in financial difficulties for many years. In February 2020, the Commission approved rescue aid of EUR 36.7 million in favour of the airline in the context of a Romanian notification.

    Examiner appointed to Norwegian Air companies

    This case is significant as it involved the appointment of an Examiner to Norwegian Air Shuttle ASA (NAS) a company incorporated in Norway with its centre of main interests in Norway rather than Ireland.

    The Norwegian Air Group comprised 65 companies and the protection of the Court was sought in respect of 5 Irish incorporated companies (the Petitioners) and NAS the ultimate parent company in the Group.

    COFIDES will manage a Recapitalisation Fund focused on strengthening the solvency of businesses affected by the pandemic.

    The Council of Ministers has approved the creation of the Fund for the Recapitalisation of Companies Affected by COVID-19 (the "FREAC"), which will be funded with 1,000 million euros and will be managed directly by COFIDES. The purpose of the FREAC is to provide a temporary public support under criteria of profitability, risk and impact on sustainable development, in order to strengthen the solvency of medium-sized companies with registered offices in Spain.
