    R3 Scotland Forum: The Route to Recovery for the Hospitality & Leisure Sector

    Guidance published for IPs dealing with FCA regulated firms

    On 12 May 2021 the FCA issued finalised guidance for insolvency practitioners who are tasked with managing insolvencies of regulated firms.

    Aiming to help insolvency practitioners understand how to deal with firms in line with FCA requirements, the guidance covers the process from end-to-end including expectations in the pre-insolvency stage and specific procedures relating to insolvencies and restructuring. The aim of the guidance is to assist with the minimising of the impact of a failure of a regulated firm

    De gerechtelijke ontbinding van uw vennootschap vermijden? Leg dan tijdig uw jaarrekening neer

    De jaarrekening neerleggen is een van de belangrijkste wettelijke verplichtingen van vennootschappen. Meer nog, bij niet (tijdige) neerlegging komt de aansprakelijkheid van bestuurders in het gedrang. Vennootschappen die hun jaarrekening niet tijdig hebben neergelegd riskeren verregaande gevolgen … zelfs na één keer. En een gewaarschuwd man of vrouw is er twee waard. U wil niet wakker worden met een vennootschap die gerechtelijk ontbonden werd terwijl u daar nog activa en activiteiten in hebt.

    New chapter 11 filing - Washington prime group
    2021-06-28

    On June 25, 2021, Inversiones CG Financial Chile Dos S.P.A. and certain affiliates, which manage investments in mainly Chilean financial institutions, filed a petition under Chapter 11 of the Bankruptcy Code in the Bankruptcy Court for the District of Delaware (Case No. 21-10968). The company estimates $500 million to $1 billion in assets and $1 billion to $10 billion in liabilities.

    Re China All Access Limited: Recognition of Hong Kong appointed liquidators in the Mainland

    In Re China Huiyuan Juice Group Limited [2020] HKCFI 2940, Harris J discussed in detail the difficulties which liquidators appointed in Hong Kong over a foreign incorporated holding company may have in obtaining control of operating subsidiaries in the Mainland, if the group’s structure includes intermediate subsidiaries incorporated in the British Virgin Islands (the “BVI”).

    Why You May Not Be Able to Avoid That Public Examination

    In the recent case of Jane v Secatore (Liquidator), in the matter of Last Lap Pty Ltd (in liq) [2021] FCAFC 108, the Court heard an appeal of a decision that dismissed an application to discharge summonses issued concerning public examinations by the liquidator of Last Lap Pty Ltd (in liquidation) (Last Lap).

    TGIF 25 June 2021 - Not all preference claims are created equal

    This week’s TGIF considers the decision of the Supreme Court of NSW in In the matter of Pacific Steelfixing Pty Ltd [2021] NSWSC 655, where a liquidator failed to adequately prove that payments to a creditor, during the relation back period, were voidable transactions because the Liquidator had not finalised investigations into the potential recovery claims available to him.
