    Set-­off of overdue receivables, when purchased after the declaration of bankruptcy, is an “abuse of a right” ?

    The Tribunal of Monza (12 October 2015) has adopted a broad application of second para. of Art. 56 of the Italian Bankruptcy Law which excludes – only for receivables non yet overdue – that a debtor of the insolvent may offset its debt against receivables which he has acquired after the declaration of bankruptcy or in the year before.

    Italy finally approves statute amending Bankruptcy Act and other laws to facilitate restructurings and reinforce creditors’ rights

    With Law No. 132 of 6 August 2015 Italy’s parliament finally passed (with some amendments) Law Decree No. 83 of 27 June 2015 (as finally converted into law, the “Decree”), amending various provisions of Royal Decree No. 267 16 March 1942 (the “Bankruptcy Act”), the civil code and the code of civil procedure, and certain tax provisions. The amendments aim to facilitate debt restructurings, support distressed companies in their turnaround attempts, and foster quicker liquidations in bankruptcy proceedings.

    Con l’art. 33 del D.L. 22 giugno 2012 n. 831 il legislatore ha ampliato il novero delle ipotesi in cui le perdite su crediti iscritte in bilancio sono deducibili ai fini delle imposte sui redditi ed esteso agli accordi di ristrutturazione dei debiti omologati e ai piani attestati di risanamento la disciplina dell’irrilevanza impositiva delle sopravvenienze attive realizzate dall’impresa debitrice in relazione alla riduzione dei debiti nell’ambito delle procedure concorsuali.
