    Proposal for European rules on pre-pack proceedings should be supported

    On 7 December 2022, the European Commission published the Proposal for a Directive of the European Parliament and of the Council harmonising certain aspects of insolvency law. This Proposal is intended to harmonise the insolvency laws of EU member states in order to make insolvency proceedings more predictable and efficient. The Proposal also includes a number of principles the pre-pack proceedings in each member state must meet.

    Ongoing innovation of the Belgian insolvency law : change of the current law and a new proposal for a European bankruptcy Directive !

    Insolvency law in Belgium will be subject to a lot of change, through the transposition of two consecutive directives of the European Union and the implementation of the case law of the European Court of Justice.     Reforms to Malta’s Insolvency Laws

    Just before going into summer recess Maltese Parliament held the first reading of three Acts which, once adopted, are bound to start changing the Maltese insolvency law landscape. These Acts will be amending the Commercial Code and will be introducing a new Insolvency Practitioners Act and a Pre-Restructuring Act.

    How does the EU Restructuring Directive compare to Chapter 11?

    On June 26, 2019, the European Parliament and the Council of the European Union published a new EU Restructuring Directive on preventive restructuring frameworks, discharge of debt and disqualifications, and measures to increase the efficiency of procedures concerning restructuring, insolvency and discharge of debt (“Directive”).

    This is an extraordinary achievement given the existing differences in restructuring regimes across EU Member States.

    EU Parliament adopts Directive on Preventive Restructuring Frameworks
    2019-04-04

    The EU Parliament adopted the Directive on future "Preventative Restructuring Frameworks.

    This creates the basis for a uniform legal framework for preventive restructuring within Europe. To date there has been a "patchwork" of regulations in the EU: in some cases there are no regulations at all, in others there are sophisticated procedures in place. The new directive now counteracts the dangers and risks of such regulatory differences.
