The UK government’s response to COVID-19 has already taken the economy into new territory, and whilst measures put in place may delay or alter the approach of companies seeking insolvency-based protections, a large number of (contentious) restructurings and insolvencies is inevitable.
We anticipate three phases, each of which creates various risks:
(i) The current phase, during which companies are able to take advantage of government support, or relaxed laws or rules around insolvencies, to continue to operate during the COVID-19 lockdown.

The robust funding environment and expectations of increased investment reflect the aviation industry's strong aggregate performance. In large parts of the sector, both liquidity and capital remain unconstrained, not least in an era of historically low financing costs.
The Central Bank of Ireland ("CBI") issued a letter to all fund management companies on 7 August 2019 ("Letter") with a timely reminder of their ongoing obligations regarding liquidity management and compliance with legislative and regulatory obligations for UCITS and AIFs. This is in the context of the CBI's continuing engagement with industry on Brexit preparedness, and it stated it will have regard to the Letter as part of its future supervisory engagements.
Overall 2018 has produced a number of positive judgments from the perspective of lenders and insolvency practitioners.

Not for the first time in the current pandemic crisis, the UK government has found itself playing catch up with other countries. Over the weekend the UK followed the lead of governments in Germany and Australia by announcing plans to introduce a temporary relaxation of the existing wrongful trading regime for company directors. It has also taken the opportunity to revive the previous government's plans to add to the existing UK insolvency law "toolkit" by introducing a new debtor-friendly restructuring law.
