    In 2017, the Quebec Court of Appeal had issued a decision in the matter of Arrangement relatif à Métaux Kitco inc., 2017 QCCA 268 ("Kitco") to the effect that the Companies' Creditors Arrangement Act (the "CCAA") prohibited the exercise of all rights of set-off between pre-filing and post-filing claims.

    In Canada, the federal government enacted the Bankruptcy and Insolvency Act R.S.C., 1985, c. B-3 (“BIA”), which is intended to relieve honest but unfortunate debtors of their debts and to organize a process that allows for an orderly administration of the estate of the debtors.

    The process created by the BIA sets out the duties and obligations of the various stakeholders involved in the insolvency proceeding and it establishes numerous deadlines by which certain tasks are required to be accomplished.

    Canada: Court approves litigation funding agreement for insolvent company
    2018-04-18

    On March 16, 2018, a Quebec Court approved a litigation funding agreement for an insolvent company operating under court-protection in a Companies’ Creditors Arrangement Act (CCAA) proceeding. The insolvent company wanted to pursue a significant claim against its primary secured creditor and the litigation funding agreement stipulated that the third party litigation funder will pay all legal fees and disbursements in relation to the proposed claim in exchange for a portion of any proceeds of the litigation.
