    Recovering payments made from bank account after bankruptcy date

    Introduction

    Recently, the Supreme Court dealt with the following question: can the bankruptcy trustee recover a payment made from a bank account with a debit balance in the name of the bankrupt company after the bankruptcy date, as undue payment due to a breach of the fixation principle or the equality of creditors principle?

    Introductie

    In het onderhavige arrest buigt de Hoge Raad zich over de volgende vraag: kan de curator een girale betaling, gedaan na datum faillissement vanaf een op naam van de failliet staande bankrekening met een debetsaldo, als onverschuldigd terugvorderen wegens strijdigheid met het fixatiebeginsel of de paritas creditorum?

    Yesterday, the European Court of Justice (ECJ) published its long-awaited judgment in Heiploeg/FNV. The ECJ rules that a pre-pack under circumstances can fall within the exception as mentioned in Article 5 (1) Directive 2001/23.

    Burgemeester aangesteld tot mede-curator in faillissement van zorginstelling

    Op 6 december 2021 heeft de Rechtbank Overijssel de burgemeester van de gemeente Hardenberg aangesteld tot mede-curator in het faillissement van De Zorgstal. Dit is een interessante ontwikkeling omdat, voor zover de auteurs bekend, een burgemeester niet eerder is aangesteld tot mede-curator in een zorgfaillissement.

    Public Dutch Scheme automatically recognized in the EU from 9 January 2022

    Since 9 January 2022, the public type of the Dutch Scheme is automatically recognized in the EU under the European Insolvency Regulation. This will be further discussed in this blog.

    Wijziging Insolventieverordening: de WHOA nu ook erkend in lidstaten EU

    De Wet Homologatie Onderhands Akkoord (WHOA) is inmiddels een jaar geleden (1 januari 2021) in werking getreden.[1] Met die inwerkingtreding werd het Nederlandse faillissementsrecht een herstructureringsmechanisme rijker. Een rechtspersoon in financieel zwaar weer kan daarmee - kort gezegd - zijn schulden herstructureren door het opstellen en aanbieden van een akkoord waaraan ook tegenstemmende schuldeisers kunnen worden gebonden middels een dwangakkoord buiten faillissement of surseance van betaling.

    Draft bill on Expedited Liquidation Transparency presented
    2021-08-02

    On 28 June 2021, the Minister of Justice presented a draft temporary bill on transparency of expedited liquidations (de tijdelijke wet transparantie turboliquidatie). As a result of the COVID-19 pandemic, the Minister expects that there will be an increase in the number of businesses that will need to be liquidated. Under Dutch law, the most efficient way to do this is through expedited liquidation (turboliquidatie). However, as the expedited liquidation barely provides for safeguards to creditors, it is often considered a mechanism that is open for abuse.
