    When an individual declares bankruptcy, the trustee-in-bankruptcy (trustee) may be able to claim, and sell, some of the bankrupt’s assets. The trustee can then use the proceeds from the sale to repay any money owed to creditors. Assets may include, but are not limited to, real estate, vehicles, tools, equipment, furniture, bank balances and lottery winnings.

    Insolvency in Spain: The Incoherence of Punishable Insolvency That Includes The Solvent Debtor

    Punishable insolvency is regulated, inter alia, in Article 260 of the Spanish Penal Code. However, section two thereof contains wording which leads to decisions that contradict the legislature’s intention; this is because the wording implies that the description of the offence includes the solvent debtor.
