    Significant innovations have been introduced in Italy by Law Decree no. 83 of 27 June 2015 (entitledUrgent Measures on Insolvency, Civil and Procedural Matters and the Organization and Functioning of Judicial Commissioners (the "Decree").The Decree was converted by the Italian Parliament into statutory law no.132 enacted 6 August 2015 (the "Conversion Law").

    Mexican court identifies requirements for audited financial statements needed to support insolvency application

    Background

    The Mexican Insolvency Act provides that a company seeking an insolvency judgment declaration must support its request with documents evidencing its lack of capacity to meet its financial obligations. Section 20 of the Mexican Insolvency Act specifies that the following documents must support the request audited financial statements for the last three years;

    Royal Decree- Law 4/2014 of 7 March 2014, on urgent matters in relation to refinancing agreements and debt restructuring

    The Spanish Council of Ministers passed on 7 March 2014 the Royal Decree-Law 4/2014, on urgent  matters in relation to refinancing agreements and debt restructuring (the "RDL 4/2014"). The RDL 4/2014 has  been published on 8 March 2014 in the Spanish Official Gazette and it entered into force on the day  immediately following its publication.

    A further step taken by Ukraine to simplify out of court loan workouts

    On 25 September 2019, the Ukrainian Parliament brought into force law No. 112-IX (the “Law“). The purpose of the Law is to correct deficiencies in existing legislation and further promote out-of-court financial restructurings in the jurisdiction. The adoption of the Law comes in light of the high volume of non-performing loans which still exist in Ukraine.

    Easing the Burden: helping businesses stay afloat in the pandemic era

    On 28 March 2020 the Secretary of State for BEIS, Alok Sharma, announced that changes would be made to the UK insolvency laws to help companies "…emerge intact the other side of the COVID-19 pandemic…to give them extra time and space to weather the storm and be ready when the crisis ends whilst ensuring creditors get the best returns possible in the circumstances".

    The UK Parliament made an Order on 3 March 2020 which increases the prescribed part, payable to unsecured creditors from floating charge recoveries on the insolvency of a company from £600,000 to £800,000.

    Back in August 2018, in its paper entitled “Government Response: Insolvency and Corporate Governance” (the 2018Paper) the Government responded to its consultation on ‘Insolvency and Corporate Governance‘ with the announcement of several reforms and proposed next steps.
