    European Parliament votes in favor of promoting cross-border rescue culture

    In Europe each year there are an estimated 200,000 corporate insolvencies. More than half of the companies set up do not survive their first five years of trading and more than 1.7 million jobs are lost every year as a result. One in five of those companies will have international operations that cross national borders.

    The European Union (EU) has sought to introduce an element of harmonization across its Member States, to facilitate the effective operation of cross-border insolvencies.

    En décembre 2013, Chypre a notifié à la Commission européenne une aide de 102,9 millions EUR pour la restructuration de la compagnie aérienne nationale Cyprus Airways.     La Commission européenne a autorisé le 28 décembre 2012 le plan de résolution du groupe Dexia et le plan de restructuration de Belfius moyennant certaines conditions.

    Depuis 2008, le groupe Dexia a bénéficié d’aides publiques qui ont été soumises à l’examen de la Commission et qui ont été autorisées par celle-ci en février 2010 sous la condition de la réalisation d’un plan de restructuration. Compte tenu des nouvelles difficultés rencontrées par Dexia, le groupe n’a pas été en mesure de respecter son engagement ni de rétablir sa viabilité à long terme.

    Amendments to the European insolvency regulation: how would “opting in” affect the UK finance market?

    In the wake of the Eurozone crisis, harmonisation of European insolvency law has been firmly on the political agenda. In December last year, the European Commission proposed amendments to the European Insolvency Regulation (EIR). The UK has until 10 April 2013 to decide whether to opt in. Luci Mitchell-Fry and Sarah Lawson consider the proposed amendments of most interest to banks and other lenders.

    Tenth anniversary of the Council Regulation on insolvency proceedings – where now?

    The tenth anniversary of the EU Council Regulation on insolvency proceedings (EC No 1346/2000) has arrived amidst wide debate surrounding whether the regulation remains valid and current in its existing form. The European Commission recently launched a consultation examining the current insolvency regime in Europe.

    Proposal for a revision of Council Regulation (EC) n°1346/2000 on insolvency proceedings

    Following a broad consultation, the European Commission presented, on 13 December 2012, its proposal for a Regulation of the European Parliament and of the Council amending Council Regulation (EC) n°1346/2000 on insolvency proceedings. Ten years after the Regulation's entry into force, the Commission has deemed it necessary to amend it in order to solve difficulties related to its practical implementation.

    European Commission proposes to amend EC Solvency Regulation
    2013-01-08

    On the 12 December, the European Commission announced the proposal to update Council Regulation 1346/2000 on insolvency proceedings. They also announce a separate initiative whereby it will be highlighting the differences between national laws that have the greatest potential to hamper an efficient insolvency legal framework across the EU.
