Over the last three and a half years, the National Bank of Ukraine has made a great many decisions removing insolvent banks from the market. This, in turn, has given rise to the disputes in which clients of banks seek the recovery of their funds (deposits, working assets) that have been trapped in their bank accounts. However, considering the restrictions applicable during the establishment of provisional administration/liquidation of banks, not everyone, and not always, succeeds in achieving the desired result.
Статистика свідчить, що судом касаційної інстанції за 2017 рік було розглянуто близько 5 тисяч господарських справ, серед яких п’яту частину спорів склали справи про банкрутство. Як бачимо, справи про банкрутство займають значну частину у структурі господарських спорів. Проаналізувавши практику Вищого господарського суду України, старого Верховного Суду України та нового Верховного Суду, хочемо звернути увагу на топ-5 найцікавіших, на нашу думку, судових рішень у справах про банкрутство, що мають важливе значення для становлення судової практики у цій категорії спорів.
У пошуках способу повернення коштів, які «застрягли» в неплатоспроможних банках, вкладники все частіше звертаються з позовами про стягнення збитків та / або відшкодування шкоди до акціонерів, що володіють істотною участю в таких банках. 2017 рік не став винятком і тенденція щодо збільшення кількості таких спорів збереглася. Чи було це дієвим способом захисту прав та інтересів вкладників? Які були особливості розгляду даної категорії спорів? On 14 July 2016, the Ukrainian Parliament adopted the Law of Ukraine “On Financial Restructuring” No. 1414-VIII (the “Law”) which, based on its transitional provisions, entered into force on 19 October 2016 and will remain valid for 3 years as of the day of its entrance into force. The Law introduces the procedure of voluntary financial restructuring of legal entities (including municipal and state enterprises) having outstanding debt(s) towards at least one financial institution which is not a related party to the entity.

Last week Verkhovna Rada approved, in principle, the Draft Law No. 3555 which introduces special procedure of voluntary financial restructuring of corporate debtors.
