    Key licensing and health and safety considerations for insolvency practitioners
    2024-03-26

    It’s been a difficult last few years for the licensed trade and the hospitality and leisure sector generally, both in terms of recovery from the Covid-19 pandemic and, more recently, the wider economic challenges facing the industry.

    The risks of void transactions in insolvency
    2022-07-25

    With the lifting of the restrictions on the presentation of winding up petitions, and the likely cash flow pressures caused by price inflation, it is widely anticipated that we will see an increase in the number of companies subject to winding up proceedings. What impact will Brexit have on corporate restructuring and insolvency?
    2016-07-04

    The United Kingdom has voted to leave the EU. Before the referendum, we considered in detail the potential impact of Brexit in the context of restructuring and insolvency. In particular we highlighted that Brexit could have an impact on cross-border restructuring/insolvency given the UK is currently viewed as a popular jurisdiction for implementing complex cross-border restructurings and insolvencies in light the regimes being widely regarded as well established, flexible and creditor friendly.

    A Scottish take on modified universalism and charges over foreign assets?
    2017-02-20

    Overview

    The following propositions for cross-border security and insolvency law in Scotland have recently been supported at first instance in the Court of Session:

    1. a floating charge need not be valid and enforceable under the law governing foreign assets charged in order to be considered valid and enforceable over such assets for the purposes of appointing an administrator out of court under the Insolvency Act 1986 (the IA);

    Beware increased court scrutiny of procedural matters
    2012-11-19

    Practitioners should be aware that recent comment from a number of the insolvency judges at the Court of Session suggests that the Court is likely to be taking a more interventionist approach to a number of insolvency applications and, as a result, practitioners may wish to review the approach taken to these applications in administration and liquidation cases.
