Detroit Institute of Arts and Motor City bankruptcy: deaccessioning fact and fiction, hope and reality
    2013-08-01

The recentfiling by the City of Detroit for bankruptcy—the largest such municipal filing in history—has brought with it an unexpected art law twist.  Namely: to what extent can, or should the collection of the Detroit Institute of Arts be used to satisfy the city’s creditors.  As one might expect, the differences between what the city can do, what it should do

The dreaded “B” word: bankruptcy and your musical works
    2013-07-08

Q: I’m in the mixing and mastering stages of an independent CD release that I’ve been working on for the past few years. When I register my copyright with the Library of Congress, I will own both the publisher’s and the songwriter’s share of the copyright. Meanwhile, I may be on the verge of filing for bankruptcy. If that happens, do I have to list my songwriter and/or publisher share of the copyright as assets with the bankruptcy trustee?

SCOTUS lets stand security interest in proceeds of bankruptcy transfer of FCC license
    2013-06-05

On May 13, 2013, the Supreme Court declined to review the ruling of the United States Court of Appeals for the Tenth Circuit1 that had held that a security interest may extend to the “proceeds” of the future transfer of a license holder’s interest in its Federal Communications Commission (“FCC”) broadcast license and that, under applicable state law, the security interest attached upon execution of the security agreement, despite the fact that the parties did not contemplate a transfer of the license at that time.

What matters: A review of 2011 and 2012
    2013-04-01

As you know, the last two years have seen a somewhat improved, but by no means robust, business climate. At the same time, structural shifts in the law firm business model have been both highly publicized and memorably demonstrated.

    Quick update
    2012-08-28

In the Summer 2009 issue of the Legal Canvas, we wrote about the wisdom of filing a UCC financing statement when art work is consigned to a gallery. Specifically, we said that the filing of a financing statement that reflects the consignor’s interest in the work provides protection against the gallery’s creditors. Financing statements take no time to prepare and cost less than $50 to file.

It could be money well spent.

Second Circuit finds Anderson News pleading is plausible... enough
    2012-06-11

Admonishing that motions to dismiss for failure to state a claim must be decided based on whether a plaintiff's complaint is plausible rather than how plausible it is, which was the district's view in granting a dismissal motion, the Second Circuit, in Anderson News, L.L.C. v. American Media, Inc.,[1] declared improper the district court's denial of leave to file a proposed amended complaint and vacated the dismissal.
