On 14 July 2016, the Ukrainian Parliament adopted the Law of Ukraine “On Financial Restructuring” No. 1414-VIII (the “Law”) which, based on its transitional provisions, entered into force on 19 October 2016 and will remain valid for 3 years as of the day of its entrance into force. The Law introduces the procedure of voluntary financial restructuring of legal entities (including municipal and state enterprises) having outstanding debt(s) towards at least one financial institution which is not a related party to the entity.

Last week Verkhovna Rada approved, in principle, the Draft Law No. 3555 which introduces special procedure of voluntary financial restructuring of corporate debtors.

14 червня 2016 р. було прийнято новий закон «Про фінансову реструктуризацію» (Закон), який повинен розв’язати багато протиріч та допомогти в проведенні реструктуризації боргів в Україні.
Закон запроваджує нову процедуру реструктуризації фінансової заборгованості українських боржників-юридичних осіб (Реструктуризація).
Особливості нової процедури Реструктуризації:
On 14 June 2016 the Verkhovna Rada of Ukraine adopted the Law “On Financial Restructuring” (the Law), which aims to solve many conflicts and assist in debt restructurings in Ukraine.
The Law provides a new procedure for restructuring financial debt of Ukrainian corporate debtors (the Restructuring).
Special features of new Restructuring procedure include:
Draft Law No. 3555 “On Financial Restructuring” (the “Restructuring Law”) aimed at creating effective mechanisms for voluntary financial restructuring of Ukrainian companies’ debts (the “Voluntary Restructuring”). The Restructuring Law is adopted as a temporary measure and will be in effect for three years. The Government expects that the Restructuring Law will result in reducing the amount of bad loans and restoring bank lending.

Introduction
The new law "On Financial Restructuring" No. 1414-VII dated 14 June 2016 ("Law") has recently been adopted by the Parliament of Ukraine. The Law came into force on 19 October and is effective until 16 October 2019. This appears to be a temporary measure to overcome a huge volume of non-performing loans in the Ukrainian lending space.
