    The United States Bankruptcy Court for the District of New Jersey denied fourteen plans of reorganization filed by Congoleum Corporation before the court finally dismissed the case on February 27, 2009. While the Congoleum bankruptcy proceedings involve numerous issues, this article focuses generally on insurer standing and specifically, on whether Congoleum’s insurers had standing to object to Congoleum’s twelfth plan of reorganization.

    5th Circuit ruling on Stanford receiver’s clawback claims

    On November 13, 2009, the Court of Appeals for the Fifth Circuit ruled in the Stanford securities fraud case that the appointed receiver lacked authority to “claw back” principal and interest proceeds distributed to innocent investors/creditors because they have a legitimate ownership interest in the proceeds held in the accounts. This precedent has important implications for this and other ongoing “Ponzi” scheme cases.

    Sweeping environmental liability under the bankruptcy carpet: fresh start is not guaranteed

    Businesses considering filing Chapter 11 for bankruptcy protection may not necessarily be able to avoid certain environmental cleanup obligations. The underlying policy goals of bankruptcy and environmental laws are in direct conflict in that bankruptcy law seeks to promote financial rehabilitation by discharging a debtor's past obligations in order to promote financial rehabilitation while environmental law seeks to ensure that the government can order responsible parties to clean up contamination, including historical pollution caused by business predecessors.

    When is it "safe" to collect foreclosure or bankruptcy-related fees?

    The collection of foreclosure and bankruptcy-related fees in Chapter 13 bankruptcy cases has been the cause of much grief for mortgage servicers of late. Learning how to do it right on the front end of a bankruptcy is the remedy. Unfortunately, the law varies to a wide degree depending upon the state where the borrower resides.     US Third Circuit further defines bankruptcy courts’ ability to enjoin actions between non-debtor affiliates and third parties

    In a decision that reaffirms its previous rulings on the jurisdictional limits of bankruptcy courts, the US Court of Appeals for the Third Circuit recently held in W.R. Grace & Co. v. Chakarian (In re W.R. Grace & Co.)1 that bankruptcy courts lack subject matter jurisdiction over third-party actions against non-debtors if such actions could affect a debtor’s bankruptcy estate only following the filing of another lawsuit.

    Dubai World restructuring – Decree No. 57

    On 13 December 2009, the Dubai Government issued Decree No. 57 for 2009, in response to the widely publicized concerns over Dubai World’s debt position. The decree established a tribunal seated within the Dubai International Financial Centre, tasked with hearing and deciding claims against Dubai World, its subsidiaries and any person related to the settlement of the financial obligations of those organizations (Dubai World). The Decree also created an entirely new insolvency law which will be exclusively applicable to Dubai World.

    Dubai World restructuring subject to special purpose government decree
