    The Pacific Andes saga: forum shopping, Chapter 11 and just and equitable winding up

    `Forum shopping' is the practice of choosing the most favourable jurisdiction in which a claim could be heard. It is often used as a pejorative, a form of jurisdictional gamesmanship, but, in principle, there is nothing wrong in seeking to have the case heard in the forum which is most favourable to the client. It can however lead to some fierce jurisdictional battles particularly in insolvency where the choice can be stark between debtor and creditor friendly procedures.

    Revised regulation 1346/2000 on insolvency proceedings: seeking strengthened efficiency in an attempt to halt the practice of forum shopping

    On 20 May 2015, the European Parliament adopted a new version (the "Revised Regulation") of Regulation 1346/2000 on insolvency proceedings (the "Original Regulation").

    According to the statement of the Council's reasons, the Revised Regulation is aimed at making cross-border insolvency proceedings more effective with a view to ensuring the smooth functioning of the internal market and its resilience in economic crises.

    New personal insolvency regime for Ireland

    Ireland’s new insolvency regime came into effect on 3 December 2013. The new regime revamps the existing bankruptcy laws and brings Ireland closer into line with our European neighbours.  It focuses on negotiating an arrangement with creditors where possible, with bankruptcy as a last resort.
