    The Court of Justice rules the Act on Nullity of Loans with an International Element Concluded in the Republic of Croatia to be against the EU Law

    In October 2018 we have elaborated on the controversial “Act on Nullity of Loans with an International Element Concluded in the Republic of Croatia”, which was passed by the Croatian Parliament and entered into force on 29 July 2017 (“Act”).

    The Act has been adopted via an urgent parliamentary procedure, without undergoing expert consultation procedure that usually precedes the procedure of passing the law with such a sensitive effect as it would be the interference with the acquired rights as a consequence of retroactive application of its provisions.

    UK jurisdiction taskforce publishes legal statement on status of cryptoassets and smart contracts: Observations from Ireland

    1. INTRODUCTION 

    1. In May 2019, the UK Jurisdiction Taskforce ("UKJT"), a subsidiary of the UK's LawTech Delivery Panel, issued a consultation paper on the status of cryptoassets and smart contracts in English private law ("Consultation Paper"). In his foreword to the Consultation Paper, Sir Geoffrey Vos, Chancellor of the High Court of England and Wales (the "Chancellor") commented that "perceived legal uncertainty" was the reason for some lack of confidence amongst market participants and investors in cryptoassets and smart contracts.1

    Case update - anti-suit injunctions, and arbitrating insolvency-related claims

    On 6 June 2018, the Commercial Court handed down its judgment in Nori Holdings Ltd v Bank Otkritie Financial Corp [2018] EWHC 1343 (Comm), and provided helpful guidance on three important issues:

    1. The Court clarified that West Tankers1 remains good law in that parties will not be granted anti-suit injunctions by the English Court to restrain proceedings commenced in other Member States in breach of an agreement to arbitrate, notwithstanding the contrary opinion expressed by Attorney General Wathelet in Gazprom (C-536/13).

    No es concursal una acción que tiene por objeto una pretensión de indemnización de daños y perjuicios por responsabilidad delictual o cuasidelictual, que ejercita el síndico en el marco de un procedimiento de insolvencia y que, de prosperar, daría lugar a la reintegración de lo obtenido en la masa activa. La competencia para conocer de ella se determina por las disposiciones del Reglamento Bruselas I (RBI, aplicado al caso por razones temporales, si bien lo decidido por el Tribunal de Justicia de la Unión Europea [TJUE] se extiende al actualmente aplicable RBIbis).

    Pensions on insolvency: CJEU suggests “poverty line” test in the Bauer case

    The Court of Justice of the EU (CJEU) has held once again that the Insolvency Directive does not require member states to put measures in place to fully fund lost pension rights on the insolvency of an employer. This conclusion is contrary to some reporting in the pensions press earlier today.
