22 Mart 2020 tarihli ve 31076 sayılı Resmi Gazete’de yayımlanan 2279 sayılı Cumhurbaşkanı Kararı (“Cumhurbaşkanı Kararı”) uyarınca; COVID-19 salgın hastalığının yayılmasını önlemek amacıyla alınan tedbirler kapsamında, 22 Mart 2020 tarihinden 30 Nisan 2020 tarihine kadar, nafaka alacaklarına ilişkin icra takipleri hariç olmak üzere, yurt genelinde yürütülmekte olan tüm icra ve iflas takiplerinin durdurulmasına ve bu çerçevede taraf ve takip işlemlerinin yapılmamasına, yeni icra ve iflas takip taleplerinin alınmamasına ve ihtiyati haciz kararlarının icra ve infaz edilmemesine karar verilmişt

As per the Presidential Decree (“The Decree”) numbered 2279, published in the Official Gazette, all enforcement and bankruptcy proceedings throughout the country, except for enforcement proceedings regarding alimony receivables, have been suspended from the day this Decree comes into effect until 30/04/2020. The Decree includes suspension of all party and legal actions and enforcement or execution of ancillary attachments. The Decree is enacted, based on Art.330 of Bankruptcy and Enforcement Law Numbered 2004.

The concept of "financial restructuring" was introduced in Turkey following the country's currency crisis in the summer of 2018. Financial restructuring, defined as revising a debtor's financial structure and redetermining its financial strategy, became the major agenda of Turkish financial institutions. Regulators intervened immediately and began working to form the legal infrastructure for restructuring.

Certain amendments are made on multiple laws concerning Turkish financial markets with the Law No. 7186 and the Capital Movements Circular in line with the letter of Ministry of Treasury and Finance dated 16 July 2019.

Gelir Vergisi Kanunu ile Bazı Kanunlarda Değişiklik Yapılması Hakkında Kanun ("Torba Kanun") 19 Temmuz 2019 tarih ve 30836 sayılı Resmi Gazete'de yayımlanarak yürürlüğe girdi. Torba Kanun finansal yeniden yapılandırmaya ve gelir vergisine ilişkin düzenlemeler içeriyor.

Bankruptcy postponement under the Turkish Bankruptcy Law was heavily criticised on the basis that it was open to manipulation. Critics also claimed the protections offered in this scope went beyond the legislators’ intentions due to systematic errors which had emerged in the process.

Recent Development 

Amendments to the Financial Restructuring Framework Agreement (the "Framework Agreement"), which was drafted by the Turkish Banks Association (the "TBA") within the scope of the Regulation Regarding the Restructuring of Debts Owed to the Financial Sector (the "Regulation"), were distributed to banks and other financial institutions to be executed.
