Insolvency Statistics

2014 was the first year in which the number of insolvency proceedings filed by Spanish companies fell each month since 2004, the year when the last bankruptcy reforms were enacted. Last year, a total of 6,508 insolvency proceedings were initiated in Spain, a reduction of 26.2% when compared to 2013, which was a record year when 8,823 cases were filed.  As a result, in 2014, the streak of consecutive years of increase in the number of insolvency filings ended.

A new milestone has been reached in the reform process of the Spanish Insolvency Act. On 25 May, the draft bill of the Law 9/2015, of urgent measures in insolvency proceedings, has finally been enacted as law. The new rule “validates” many of the modifications introduced by the latest Royal-Decree Laws, with some changes.

El pasado miércoles 27 de mayo de 2015 se produjo la entrada en vigor de la Ley 9/2015, de 25 de mayo, de medidas urgentes en materia concursal. Se termina así el proceso de conversión en Ley del Real Decreto-Ley 11/2014, de 5 de septiembre (ver e-bulletin publicado).

1. La excepción a la regla general: el adquirente no se subroga en los créditos de la Seguridad Social con garantías

1.1. El nuevo artículo 149 de la Ley Concursal (LC) establece una serie de reglas legales de liquidación. El primer apartado de la norma recoge las reglas supletorias previstas para cuando no se apruebe un plan de liquidación o, de haber sido aprobado éste, para aquello que no hubiere sido previsto en él.
