    Congress Passes $2.2 Trillion COVID-19 Stimulus Bill

    On Friday, March 27, 2020, the U.S. House of Representatives voted to approve the Coronavirus Aid, Relief, and Economic Security Act (“CARES Act”) submitted by the Senate and President Trump just signed the bill. The bill provides for $2.2 trillion in emergency aid to ease the financial impact of the COVID-19 crisis.

    No Dice: State Law Precludes Recovery of $50,000,000 Gaming License Fee

    In 2007, Philadelphia Entertainment and Development Partners, LP dba Foxwoods Casino Philadelphia (“Plaintiff”) secured a gaming license from Pennsylvania for $50,000,000 with the understanding that it open its casino business within one year. Plaintiff failed to do so and, despite a number of extensions, Pennsylvania cancelled and revoked the gaming license in December 2010. Without a gaming license, Plaintiff found itself in chapter 11 by spring of 2014.

    Third Circuit Enforces Tenant’s Rights After Debtor’s Sale of Real Property and Rejection of Lease

    In IDEA Boardwalk, LLC v. Revel Entertainment Group, LLC (In re Revel AC Inc.), Case No. 17-3607, –F.3d–, 2018 WL 6259316 (3rd Cir. Nov. 30, 2018), the Third Circuit Court of Appeals recently enforced a tenant’s right to offset rent under a rejected lease of real property, pursuant to section 365(h) of the Bankruptcy Code and the doctrine of equitable recoupment.

    Low Cost Holidays goes into administration leaving thousands with only a few pounds compensation

    A leading travel lawyer has warned holiday makers to double check that they book their holidays through an Atol registered travel company after thousands of customers were potentially left with just a few pounds in compensation after the un-registered Low Cost Holidays went into administration late last week.

    It is believed there are as many as 27,000 customers abroad, and 110,000 with future bookings with the company.

    South West hospitality businesses at risk while agriculture goes from strength to strength

    Over a third of South West pubs (33%) and restaurants (38.4%) are at heightened risk of insolvency in the next 12 months, according to research by R3, the insolvency trade body.

    However, agricultural businesses in the South West have demonstrated increased strength since this time last year with 17% of business at risk, representing a 9.6% decrease in the proportion since February 2015.
