    Navigating Asset Tracing Challenges in Bankruptcy

    The uptick in bankruptcy cases will mean more work for insolvency professionals who specialize in asset tracing. Some of the most interesting work will arise in cases where companies engaged in significant fraud.

    Each bankruptcy cycle has these cases. In 2001, Enron Corp. filed for bankruptcy. In 2008, there was Bernie Madoff. The latest example is FTX Trading Ltd.

    Pre-pack insolvency and restructuring options in Hong Kong

    Hong Kong is the only common law jurisdiction within the People’s Republic of China and one of the few financial centres in the world without a formal rescue mechanism in its legislation. Hong Kong has not enacted legislation to recognise corporate rescue over simple liquidation.

    Pre-pack insolvency sales in Poland and the EU draft Directive

    In Poland, pre-pack insolvency sales have been available since 1 January 2016.     Preventive restructuring finally arrives in the Czech Republic—and it may affect you more than you realise

    Scotland v England (Set-Off)

    The recently reported decision of ICC Judge Greenwood in Grove Independent School Ltd, Re [2023] EWHC 2546 (Ch) (Grove) provides some clarity on the test to be applied by the court in deciding whether to exercise discretion to grant an order for a Part A1 moratorium. In this case, the company in question was also faced with a winding-up petition, presented by His Majesty's Revenue & Customs (HMRC).
