    Oberlandesgericht München bestätigt: Kein Versicherungsschutz für Ansprüche gemäß § 64 GmbHG

    Das Oberlandesgericht München hat in einem bisher unveröffentlichten Hinweisbeschluss[1] die Rechtsauffassung des Oberlandesgerichts Celle[2] und des Oberlandesgerichts Düsseldorfs[3] bestätigt, dass für Ansprüche des Insolvenzverwalters gegen Geschäftsführer wegen Zahlungen trotz Insolvenzreife kein Versicherungsschutz unter einer D&O-Versicherung besteht. Daneben hat das Oberlandesgericht München auch zur Verteilung der Darlegungs- und Beweislast in Abtretungskonstellationen Stellung bezogen.

    New Bankruptcy Law in the Kingdom of Saudi Arabia

In this regard, when companies go global, insolvency is perhaps the furthest thing from their minds.     Hanjin Shipping - Current jurisdictional status and options - United States of America

    On 2 September 2016, Hanjin filed a petition under Chapter 15 of the U.S. Bankruptcy Code in the U.S. Bankruptcy Court for the District of New Jersey, seeking recognition of its Korean rehabilitation proceedings as a "foreign main proceeding." Hanjin also sought provisional and final relief to prevent creditors from taking enforcement actions against Hanjin's interests within the jurisdiction of the United States.

    Validity of mortgages established on vessels owned by company in bankruptcy

    On 21 October 2013, the financially troubled company Hainan PO Shipping applied for bankruptcy and winding up before the People’s Court of Hainan Yangpu Economic & Development Zone (“Yangpu Court”). The Yangpu Court approved the application on 31 October 2013, and the Court has since nominated the administrators of Hainan PO Shipping.
