Insolvency consultation puts governance in the spotlight
    2018-04-10

We closed the first quarter of 2018 following a period of intense scrutiny on the restructuring and insolvency profession. The stress in the retail and dining sectors, the increase in CVAs and the various attendances of stakeholders in the profession before Select Committees has been the forerunner to two consultation papers.

A guide to the insolvency aspects of the new Deregulation Act and Small Business, Enterprise and Employment Act
    2015-05-05

On 26 March 2015, the Deregulation Bill and the Small Business, Enterprise and Employment Bill received Royal Assent.  These Acts make a number of important changes to the law affecting directors, insolvency law and regulation.

The changes affect (among other things) directors’ liabilities, the powers of administrators and the rights of creditors. While some changes are relevant to all those advising companies and directors, others are of interest principally to insolvency officeholders.

Pre-administration rents - disappointment for landlords
    2012-04-05

Landlords have lost round two in the ongoing battle as to whether rent should be paid as an expense of the administration. The decision of the Court last week in the X-Leisure / Luminar case was in favour of administrators.

Following the Goldacre case, if an administrator is using the property for the purposes of the administration on the quarter day then the full quarter’s rent is payable as an expense of the administration.  What was not clear, was whether if the administrator was appointed just after the quarter day rent was payable as an expense.

Directors Duties in the UAE: Part 3 - Duties in times of Financial Uncertainty
    2020-05-11

    Introduction

With global economies facing uncertain times as a result of the COVID-19 pandemic, and many businesses facing significant challenges to cash flow, revenue and bad debts, the possibility of insolvency will be very real for some companies in the UAE. In such circumstances it is important that directors fully appreciate how their duties and liabilities will be impacted and ensure decisions made in a financial distress situation are made in full consideration of these.
