    Flying in turbulent times - the voluntary administration of Virgin Australia

    In what has been Australia’s largest corporate scalp in the wake of the COVID-19 pandemic, Virgin Australia has appointed partners from Deloitte as voluntary administrators. The decision to appoint administrators reportedly arose from the Federal government’s refusal to inject $1.4b as part of a recapitalisation proposal.

    "Help is on the way" - The Swiss COVID-19 Insolvency Law Ordinance

    On April 20, 2020, the Swiss (only German) came into force, after an emergency legal freeze ended on April 19, 2020 (see our blog post "Federal Council orders a nationwide stay of debt enforcement proceedings"). However, no end of the corona pandemic is in sight.

    “Light Touch” Administrations

    The restructuring and recovery profession is seeking to quickly adapt to the economic strain and disruption presented by the COVID-19 pandemic. Whilst new restructuring procedures may soon be introduced to provide distressed companies with protection, the industry has been encouraged to innovate with the tools it already has. One possible option that is developing is the concept of “light touch” administrations. The extent of the “light touch” and the suitability of the option will depend on each scenario.

    COVID-19: Federal Council implements additional measures and adjustments to insolvency legislation

    On 16 April 2020, the Federal Council implemented the measures aiming at preventing corona-related bankruptcies. The measures come into force on 20 April 2020 and are limited to six months.
