    De jaarrekening neerleggen is een van de belangrijkste wettelijke verplichtingen van vennootschappen. Meer nog, bij niet (tijdige) neerlegging komt de aansprakelijkheid van bestuurders in het gedrang. Vennootschappen die hun jaarrekening niet tijdig hebben neergelegd riskeren verregaande gevolgen … zelfs na één keer. En een gewaarschuwd man of vrouw is er twee waard. U wil niet wakker worden met een vennootschap die gerechtelijk ontbonden werd terwijl u daar nog activa en activiteiten in hebt.

    COVID-19 drives changes to judicial reorganisation procedures

    The COVID-19 crisis has emphasised the importance of having performant insolvency proceedings. As of now, new measures are in force which aim to optimise the judicial reorganisation procedure. We elaborate on the three most relevant changes.

    Belgian insolvency law organises two main types of insolvency proceedings: bankruptcy (faillissement/faillite) which is a winding-up proceeding and judicial reorganisation (gerechtelijke reorganisatie/réorganisation judiciaire) which is a safeguard proceeding.

    The European Commission proposes EUR 3.7 million to support the 1,500 former workers of Swissport Belgium

    Swissport Belgium, one of the two licensed ground handling service providers at Brussels Airport, was declared bankrupt in June 2020, three months after the airport's operations were interrupted due to measures adopted by the Belgian government to limit the spread of COVID-19. Nearly 1,500 workers lost their jobs.

    In order to support these workers, Belgium applied for assistance from the European Globalisation Adjustment Fund (EGF) to help these redundant workers back into employment (especially those with no professional qualifications or with a low level of education).

    Cette loi intervient presque deux mois après la fin du moratoire général sur les faillites en place depuis le 28 octobre 2020 et qui prenait fin le 31 janvier dernier.

    Easier access to the JRP provides extra oxygen for struggling businesses

    Expected for almost two months, the law that partially and temporarily modifies the insolvency legislation has been adopted on 21 March 2021 at last.

    This is nearly two months after the general moratorium on bankruptcies, that was in force since 28 October 2020, expired.

    1. Why this legislative intervention was necessary

    The main purpose of this measure is to adapt the existing restructuring toolbox to the needs of Belgian companies facing major financial difficulties due to the corona crisis.

    A solution for companies in difficulty

    As requested by practitioners for several months, the legislator has finally amended the Belgian Code of Economic Law to complete the range of tools available to companies in distress to allow them achieve their financial recovery. The publication of these amendments in the Belgian Official Gazette took place on Friday 26 March 2021, making them effective immediately.
