    The international recovery of debts: an array of possibilities

    Companies have a lot more international debtors as a result of globalisation and internationalisation of trade, making the recovery of debts a lot harder. It is a good thing that the law is evolving more and more towards making the recovery of international debts simpler and faster.

    Suppose a Belgian company has a claim on a French buyer, but the latter refuses to pay. The Belgian company therefore wants to seize the buyer's movable assets in France. Which steps should be taken to achieve this?

    La nouvelle loi sur l'insolvabilité est entrée en vigueur ce 1er mai 2018. La loi sur la continuité des entreprises (LCE), en tant que loi distincte, telle qu’elle existait jusqu’à récemment, a cessé d'exister et a été révisée et pleinement intégrée dans le livre XX CDE.

    Het insolventierecht hervormd (Deel II): De procedure tot gerechtelijke reorganisatie wordt strenger

    Op 1 mei 2018 is de nieuwe insolventiewetgeving in werking getreden. De Wet Continuïteit Ondernemingen (WCO) is als aparte wet opgeheven wordt onder gewijzigde vorm volledig geïntegreerd in Boek XX WER.

    Het insolventierecht hervormd (Deel III): Aansprakelijkheid van bestuurders bij insolventie

    In het kader van de hervorming van het insolventierecht die op 1 mei 2018 van kracht is geworden, heeft de wetgever een aantal belangrijke wijzigingen doorgevoerd inzake de aansprakelijkheid van bestuurders bij een faillissement. De herziene aansprakelijkheidsregels gelden voor bestuurders van vennootschappen en niet voor natuurlijke personen die ondernemingen zijn maar geen vennootschapsstructuur hebben.

    Vanaf 1 mei 2018 ziet het Belgische insolventielandschap er anders uit ingevolge de inwerkingtreding van het gloednieuwe insolventierecht (Boek XX in het Wetboek Economisch Recht). In navolging van de elektronische aangifte van schuldvordering sinds 1 april 2017, dient vanaf 1 mei 2018 ook de aangifte van faillissement elektronisch te gebeuren in het Centraal Register Solvabiliteit (Regsol).

    New legislation on insolvency approved
    2017-07-20

    On 13 July 2017 parliament voted to introduce book XX "Insolvency of Companies" in the Code of Economic Law.

    In a previous article we already wrote that the insolvency law would be adapted to current national and international regulations and case law and would be incorporated into the Code of Economic Law as a coherent whole.

    In this way, solvency procedures must be more transparent, efficient and effective.
