    Kwartaalupdate Bestuurdersaansprakelijkheid Q2 2022

    In het tweede kwartaal van 2022 zijn op www.rechtspraak.nl 52 uitspraken gepubliceerd waarin de ingestelde vordering gegrond was op bestuurdersaansprakelijkheid. Het betrof 3 uitspraken van de Hoge Raad, 6 conclusies van de advocaat-generaal bij de Hoge Raad, 15 uitspraken van de gerechtshoven en 28 van rechtbanken.

    Hoge Raad geeft duidelijkheid over positie werknemers bij een doorstart

    Op 17 april 2020 heeft de Hoge Raad een belangrijk tussenarrest gewezen inzake het pre-pack faillissement van Heiploeg. Uit dit arrest blijkt dat de Hoge Raad van oordeel is dat de regels van Overgang van Onderneming (hieronder nader uiteengezet) niet van toepassing zijn bij een doorstart na faillissement.

    Aansprakelijkheid van bestuurders en commissarissen: de stand van zaken anno 2019

    Dutch Supreme Court confirms Yukos bankruptcy cannot be recognised in the Netherlands

    The Dutch Supreme Court today confirmed the decision of the Amsterdam Court of Appeals which found that the bankruptcy of Russian oil company Yukos cannot be recognised in the Netherlands because it came about in a manner which violates Dutch public policy. Today's decision marks the end of a court battle that lasted more than a decade.

    Loss owing to vacancy and the bank guarantee; a sequel
    2018-10-03

    Claiming damages for the loss/harm sustained by a lessor as a result of the lessee’s insolvency (i.e. ”loss owing to vacancy” [leegstandschade]) is an issue that comes up again and again. The Dutch Supreme Court has rendered a series of rulings on this matter, the most recent of which dates from 17 February 2017. On 3 July 2018, the Court of Appeal in The Hague delivered its judgment after the case had been referred back to it.

    Interest accrued during a suspension of payments does count in bankruptcy
    2017-12-19

    On 24 November 2017, the Dutch Supreme Court ruled that in the event a suspension of payments is converted into a bankruptcy, interest that accrues after the suspension of payments was granted, but before the debtor was declared bankrupt, can be presented to the bankruptcy trustee for verification (HR 24 November 2017, ECLI:NL:HR:2017:2991).
