Coronavirus crisis triggers short-term relaxed insolvency laws.
    2020-03-24

It distresses me to even contemplate how many businesses operating in the construction industry will eventually succumb to some form of insolvency as a result of the coronavirus (COVID-19) crisis (event).

These are extraordinary times and as such, it cannot be ‘business as usual’ in terms of how the construction industry is regulated in terms of insolvency.

In an article in the Financial Review dated 17 March 2020, it is stated:

    Filed under:
Australia, Insolvency & Restructuring, Helix Legal, Coronavirus, PricewaterhouseCoopers, Corporations Act 2001 (Australia)
    Authors:
    Michael Chesterman
    Location:
    Australia

New laws targeting illegal phoenix activity are no magic bullet
    2020-03-05

The changes create new civil and criminal offences for the transfer of assets which are “creditor-defeating dispositions”, and also give ASIC, the ATO and liquidators additional powers in a bid to increase successful enforcement of these new laws.

    Filed under:
Australia, Capital Markets, Employee Benefits & Pensions, Insolvency & Restructuring, Moulis Legal, Liquidation, Australian Competition and Consumer Commission, Australian Securities and Investments Commission, PricewaterhouseCoopers

    2020-06-08

The recent decision in Re The Liquidator of Shenzhen Everich Supply Chain Co, Ltd (in liquidation in the People’s Republic of China) [2020] HKCFI 965 reaffirms the willingness of the Hong Kong Companies Court (the “Companies Court”) to recognise the winding-up of a company in Mainland China and thereby grant recognition and assistance to liquidators appointed in the Mainland.

    Coronavirus, Directors Duties and Insolvency
    2020-03-23

One area of practice where clarity by the government will be essential is whether directors are going to be held to all the same standards during this crisis as they are in any other recession.
