On September 6, 2012, the Commission des lésions professionnelles (the CLP) deliberated on the interpretation of article 316 of An Act Respecting Industrial Accidents and Occupational Diseases(the Act) which states that the Commission de la santé et de la sécurité du travail (the CSST) can require from an employer that retains the services of a contractor to pay the assessment due by said contractor.

Whether rent due should be treated as an insolvency expense (paid in preference to unsecured creditors and the insolvency practitioner's fees/expenses) remains controversially topical. Employers are obliged to carry out collective consultation with appropriate representatives when proposing to dismiss 20 or more employees from an establishment over a 90-day period: the length of the consultation period is dependent on the number of employees being dismissed. 

In a succinct decision rendered on January 12, the same day as the hearing, the Supreme Court of Canada finally settled the question of whether requirements to pay, issued pursuant to section 317 of the Excise Tax Act ("ETA") prior to the bankruptcy of a tax debtor, but not paid before such time, remain valid against the garnishee.1 Supreme Court Justice LeBel, speaking on behalf of the Court, simply stated that the Court agreed with the reasons of Noël J.A. of the Federal Court of Appeal.

As this note goes to press, there is a fresh round of tenant insolvencies.  Administrators are again presenting proposals to landlords that severely reduce their rights to rent and to control who occupies their premises.

We have advised on many such proposals and secured payment of significant sums due to landlords.  Don't just accept terms proposed by administrators before taking advice.

The Insolvency Act 1986 makes provision for, amongst other things, bankruptcy and Debt Relief Orders.

When a person is made bankrupt, his property vests in the trustee in bankruptcy. Some items, however, are excluded from the estate, including any assured or secure tenancy (s283). Once a bankruptcy order has been made, no creditor in respect of a debt provable in the bankruptcy may have any remedy against the property of the bankrupt 'in respect of that debt' (s285(3)(a)).
