On 31 December 2024, the Fifth Circuit Court of Appeals (the "Federal Court of Appeals") ruled that the uptiering transaction conducted by Serta Simmons Bedding LLC ("Serta") did not constitute an "open market purchase", reversing the 2023 summary judgment of the Bankruptcy Court for the Southern District of Texas (the "Texas Bankruptcy Court") that rejected the excluded lenders' claims for breach of the credit agreement. The Federal Court of Appeals also reversed the approval of certain plan provisions relating to an indemnity for the uptiering transaction.

The oil and gas industry in Texas is currently facing a double whammy from the recent oil price shock and COVID-19 related demand reductions. While exploration and production operators in Texas are proactively taking self-help measures to reinforce their financial frameworks — reducing capital spending, operating expenses, overhead and dividends — the outlook remains highly uncertain.

Op 25 januari 2017 hebben de voormalig bestuurders en commissarissen van Meavita een schikking getroffen met de curatoren voor een bedrag van EUR 1,8 miljoen, zonder daarbij aansprakelijkheid te erkennen. De FNV is geen partij bij deze schikking, waardoor de (mede) door de FNV ingestelde enquêteprocedure in beginsel doorloopt. Of de FNV ook doorzet in de enquêteprocedure bij de Ondernemingskamer is nog onduidelijk.
