Termination for insolvency: how can suppliers protect their position?
    2020-09-29

Suppliers can no longer rely on contractual terms entitling them to terminate a contract on the grounds of a corporate customer’s insolvency (ipso facto clauses) in most cases. This prohibition was introduced by the Corporate Insolvency and Governance Act which came into force on 26 June 2020 (the Act). This briefing looks at the changes suppliers may need to make to their contracts, as well as to their credit and enforcement strategies, in light of this prohibition.

The Corporate Insolvency and Governance Act 2020 makes the most significant changes to UK insolvency law in a generation. It had a rapid passage through the UK parliamentary process, making its way from first publication on 20 May 2020 to Royal assent on 25 June 2020 in just over five weeks. This article provides a brief overview of the key measures introduced by the Act (both permanent and temporary) and summarises the amendments made to the Act during its progress through parliament. The impact of the Corporate Insolvency and Governance Act 2020 on the construction industry
    2020-09-28

The Corporate Insolvency and Governance Act 2020 (the Act) received royal assent on 25 June 2020 and is now in force, bringing with it significant changes to the insolvency world and the operation of the construction industry.

The current COVID-19 pandemic has placed many companies registered in England and Wales into a position where they are now either balance sheet or cash flow insolvency or both. The loss of these companies to the economy would be catastrophic and, as a result, the UK Government started the Bill’s passage through parliament on 3 June 2020.
