    Antal konkurser ökade med 31 procent under 2023

    Över 8 200 företag försattes i konkurs under 2023, vilket innebär en ökning med 31 procent jämfört med föregående år, enligt statistik från Creditsafe. 2023 går till historien som det högsta konkursåret sedan Creditsafe började med sina mätningar 1999.

    Konkursstormen som pågått i sjutton månader har drabbat både stora och små företag i alla län och branscher. Värst drabbat är sportsektorn, bilhandlare och bygg. Under året gick 1,08 procent av Sveriges aktiebolag i konkurs. Höga konkurstal kommer fortsätta prägla 2024.

We have seen a number of airlines defaulting on their lease agreements and loan facilities. Staten har bidratt med ulike ordninger i form av ren støtte og utsatt betalingsfrist for ulike typer skatter og avgifter. Dette kan medføre at styret må foreta grundige vurderinger om hvorvidt det er grunnlag for videre drift i selskapet. Som styremedlem bør du derfor sette deg ekstra godt inn i de plikter som knytter seg til vervet.

    Hvis styremedlemmer ikke har gjort jobben sin, bør de frykte krav fra kreditorene dersom selskapet går konkurs.

    Foreign judgments can be enforced in Norway if (a) the parties have agreed to the jurisdiction of the foreign court or (b) there is a treaty between Norway and the relevant foreign country on the enforcement of judgments. Generally speaking there is only one treaty relevant for the enforcement of foreign commercial judgments in Norway, the Lugano Convention.

    Han skrev styreprotokoll. Men han glemte å skrive generalforsamlingsprotokoll. Det kostet ham mange hundre tusen kroner. Det er dyrt ikke å passe på formalitetene.

    Han hadde startet et eiendomsprosjekt. Banken krevde at 50 prosent av leilighetene måtte selges før igangsettelse. For å oppfylle kravet og sikre likviditet til selskapet ble noen leiligheter solgt med rabatt for å få opp interessen i startfasen. Han kjøpte selv en av leilighetene med rabatt. Han passet på at kjøpet hans ble styrebehandlet.
