    Wisconsin Court Clarifies Look-Back Period for Fraudulent Transfers

    In October 2018, the Wisconsin Court of Appeals reversed a decision by Circuit Court Judge Clare Fiorenza that previously granted summary judgment on behalf of certain defendants. The plaintiff in the case is the Committee of Unsecured Creditors, which represents the interests of approximately 140 unsecured creditors in the Chapter 11 bankruptcy case of Great Lakes Quick Lube LP.

    Sears/Kmart Store Closings Should Spur New Economic Activity

    In the wake of Sears’ pending Chapter 11 proceeding, the company has initially sought court approval to close approximately 234 stores across the U.S., including branded locations of Sears and Kmart (which merged with Sears in 2005 in a prior bankruptcy). Those stores include approximately five in Wisconsin, 11 in Illinois, four in Colorado, four in North Carolina, and five in Utah – all states in which Michael Best has offices. The Bankruptcy Court for the Southern District of New York is set to hear the matter on November 15, 2018.

    The Wisconsin Supreme Court puts judgment creditors at risk by changing 150 years of law on how to obtain a priority lien against a judgment debtor’s personal property

    On July 15, 2014, the Wisconsin Supreme Court made it much more difficult, costly and cumbersome for a judgment creditor to obtain a priority lien against the personal property of a judgment debtor. Associated Bank, N.A., v. Jack W. Collier, 2014 WI 62. Two members of the court disagreed with the decision and argued that it has changed 150 years of Wisconsin law.

    U.S. Supreme Court rules that inherited IRAs not protected by federal bankruptcy exemptions

    The U.S. Supreme Court resolved a split among the circuits, holding that assets in non-spousal inherited individual retirement accounts are not exempt or protected from claims of the heir’s creditors. Clark v. Rameker, 573 U.S. ___ (2014) (No. 13-299; June 12, 2014).

    “Inherited” IRAs hold funds from persons who established Individual Retirement Accounts for their own use and died before depleting the funds in those accounts. The U.S. Supreme Court affirmed the judgment by the Seventh Circuit Court of Appeals {In re Clark, 714 F.3d 559 (7th Cir. 2013)}.
