    Governor Cuomo appoints Assemblyman Jonathan Bing to head New York Liquidation Bureau

    On June 8, 2011, Governor Andrew M. Cuomo announced the appointment of Assemblyman Jonathan Bing to serve as Special Deputy Superintendent of the New York Liquidation Bureau, an agency tasked with protecting policyholders and creditors of insurance companies that have gone bankrupt.  Bing steps in as the successor to Dennis J. Hayes, who was appointed to the position in September 2009.  Bing’s appointment ends his fifth term in the New York State Assembly, where he has represented the 73rd District since November 2002.

    California restricts access of municipalities to Chapter 9 of the Bankruptcy Code

    Numerous municipalities in California and elsewhere are struggling financially. Indeed, Harrisburg, Pennsylvania and Central Falls, Rhode Island have both recently filed for Chapter 9 protection. State governments may have neither the economic reserves nor the political will to bail out troubled cities and counties. These circumstances have raised the focus on Chapter 9 as a tool for reorganizing municipality debt obligations and has deepened the debate between states and their municipalities about the best strategies for addressing a fiscal crisis.

    Proposed California legislation would mandate asbestos bankruptcy trust disclosures statewide

    California Assemblyman Ken Cooley (D-Rancho Cordova) has introduced and sponsored Assembly Bill No. 597, the Asbestos Tort Claim Trust Transparency Act, which if passed would require asbestos plaintiffs to disclose all asbestos bankruptcy trust claim documents in asbestos tort actions.
