Inside Africa - one year on

Investors continue to be drawn to the continent of Africa. The region’s abundant natural resources, strong renewable energy market and volume of infrastructure projects more than justify this level of investor interest. A year ago we launched Inside Africa: a repository for knowledge gained through on-the-ground experience in more than 45 jurisdictions. This site is led by a dedicated team of lawyers, all of them working on Africa-related transactions. Over the past year Inside Africa has been accessed nearly 50,000 times.

On January 11th 2017, the Parliament of the Democratic Republic of Congo adopted a new law substantially limiting subcontracting activities to companies (i) incorporated in DRC, (ii) with a Congolese share capital and (iii) “promoted” by Congolese. Since 24 December 2015, the 17 African Member States of the organisation for the harmonisation of business law in Africa (OHADA) have benefited from modernised, streamlined collective proceedings designed to preserve viable companies, enhance predictability and maximise recoveries for creditors. Largely inspired by French law, the reforms create a new preventive proceeding, introduce a new money privilege, clarify existing legal provisions and provide for the cross-border recognition of insolvency proceedings.
