“Stay Pending Motion to Dismiss for Lack of Personal Jurisdiction”

In ASI v. Aquawood, the magistrate judge granted in part and denied in part the defendants’ motion to stay the lawsuit. The magistrate judge denied the stay relief pending the final conclusion of the Hong Kong liquidation proceedings, chapter 15 case, and pending federal appeal. In doing so, the magistrate judge concluded that the other ongoing disputes in the other matters, including for discovery sanctions and attorney fees, did not substantially overlap with the complaint in the lawsuit that raised claims for fraud, abuse of process, civil conspiracy, and civil RICO violations. However, the magistrate judge granted a temporary stay pending decision by the district court on a motion to dismiss the complaint for lack of personal jurisdiction.
