China's Tortious Liability Law (Tort Law) came into effect on 1 July 2010. The Tort Law provides general rules on causation and liability, and also sets out principles for determining liability in a range of circumstances.
Foreign investors in China should be aware of what the Tort Law says about:
• vicarious liability for employees
• product liability (including punitive damages and product recall)
• occupier's liability
• environmental pollution liability
• infringement of privacy
