Trading Places on Traded Claims: Debtor’s Avoidance Defense Follows the Claim

The United States Court of Appeals for the Third Circuit recently held that bankruptcy claims subject to disallowance under section 502(d) of the Bankruptcy Code will also be disallowed in the hands of an assignee or purchaser of the claim.
