Foreign representative was appointed in chapter 15 case three years after the foreign proceeding closed. Creditors' objection that delay in the appointment of foreign representative runs askew of the statutory requirements overruled. Court finds no authority precluding the appointment of a foreign representative after foreign proceeding has been closed. The delay of chapter 15 was based on practical considerations where chapter 15 could be avoided if debtor prevailed in pending litigation.
