In In re Lupatech, the United States Bankruptcy Court for the Southern District of New York granted the foreign representative’s motion to recognize and enforce certain orders pursuant to 11 U.S.C. §§ 1507 and 1521 to enforce and consummate a plan approved by a foreign court. In doing so, the bankruptcy court ordered U.S. intermediaries to carry out court orders to acknowledge the exchange of new notes and subscription warrants and make distributions accordingly. The bankruptcy court closed the chapter 15 cases as fully administered.
