The Court granted an order amending the foreign main proceedings, substituting the rescuer professionals for liquidator professionals.  The Court also allowed discovery to continue.  The decision was made upon determining that the Court has the authority to modify the prior order pursuant to 1517(d) which incorporates the Model Law on Cross-Border Insolvency and permits modification of recognition if the grounds for the original granting have ceased to exist. The court also applied Fed R. of Civil P. 25(c) to substitute the representative as a party in Chapter 15, and 1522(c) which allows the court to modify or terminate the relief.
